1. Our Services:

Luphix Designs provides two major services: Concept Design (spatial planning, 3D visualization, and material/finish direction) and Installation Supervision (scheduled site inspections comparing on-site work against the approved concept, with written reports). Luphix Designs does not act as a contractor and does not execute physical construction or fit-out work.

 

2. Scope of Concept Design:

Concept Design includes spatial planning, photorealistic 3D renders, and indicative material/finish direction, delivered as a presentation-ready package. It does not include procurement management or supplier sourcing, unless separately agreed in writing. Concept Design is delivered digitally and is available to clients regardless of location.

 

3. Scope of Installation Supervision:

Installation Supervision requires physical site presence and is offered across Uganda, Kenya, Rwanda, and Tanzania, the four countries Luphix Designs serves. For all projects, travel and related costs are quoted and agreed in advance as part of the engagement. Luphix Designs is not the contractor, does not manage or direct contractor labor, and is not liable for the contractor's workmanship, delays, material availability, or any other aspect of physical execution. Our role is to observe, compare, and report - responsibility for construction quality rests with the client's contractor.

 

4. Ownership of Design Work:

Concept designs, renders, and drawings remain the intellectual property of Luphix Designs until full payment has been received. Upon full payment, the client receives the right to use the approved concept for the specific project it was created for. Luphix Designs retains the right to use renders, anonymized project details, and finish/material photography for portfolio and marketing purposes, consistent with the confidentiality approach described on the Portfolio page - full client identification is never used without separate permission.

5. Payment, Deposits, and Currency:

A deposit is required to confirm a booking and secure a project start date. (Usually the  deposit percentage for small to medium projects is set at 70% of the total project cost; and for large or specialized projects, 50% Commitment Deposit prior to kickoff, 40% upon preliminary concept delivery, and 10% final balance prior to handing over high-resolution photorealistic renders and CAD files.) Deposits are non-refundable once design work has begun, but are refundable if Luphix Designs is unable to begin the engagement as scheduled. Clients across Kenya, Uganda, Rwanda, and Tanzania pay via the same Pesapal checkout, which offers local mobile money, bank transfer, and card depending on your country. Quotes may be given in Ugandan Shillings (UGX), Kenyan Shillings (KES), Rwandan Francs (RWF), Tanzanian Shillings (TZS), or US Dollars (USD), depending on the client's location.

6. Client Responsibilities:

The client is responsible for providing site access (or, for remote Concept Design, accurate photos, measurements, and drawings), timely decisions and approvals, and accurate project information. Delays caused by the client or their contractor are not the responsibility of Luphix Designs.

 

7. Cancellations & Terminations:

• Cancellation Prior to Project Commencement: Clients may cancel a booking by providing at least seven (7) business days' written notice prior to the agreed project start date. In such cases, any deposit paid will be refunded in full, minus any non-refundable payment processing fees incurred via Pesapal, MTN Mobile Money or AIRTEL Moblie Money.

• Cancellation After Work Has Begun (Concept Design): Once design work, spatial planning, or 3D rendering has commenced, the initial deposit is strictly non-refundable. If a project is cancelled mid-phase by the client, Luphix Designs will calculate completed work up to the cancellation date. The client will be invoiced for logged work exceeding the deposit or issued a pro-rated refund for any unearned retainer fees.

• Cancellation or Rescheduling of Installation Supervision: Either party may terminate ongoing site supervision services by providing fourteen (14) business days' written notice. Scheduled site visits cancelled with less than forty-eight (48) hours' notice will be charged at the full single-inspection rate. Any prepaid, non-refundable travel expenses incurred for site visits outside Uganda (e.g., flights, transport, accommodation) will be reimbursed by the client.

8. Regional Coverage:

Luphix Designs serves clients across Uganda, Kenya, Rwanda, and Tanzania. Concept Design is delivered remotely and does not require the client's presence in Uganda. Installation Supervision requires physical site presence and is available across all four countries, subject to the travel terms in Section 3. Communication, drafts, and approvals may be conducted electronically (email, video call, Zoom,  WhatsApp) to accommodate different locations within the region.

9. Governing Law

These terms are governed by the laws of the Republic of Uganda, regardless of the client's location. Disputes will first be addressed through direct discussion between the parties - conducted remotely where necessary - and if unresolved, through the appropriate courts of Uganda.

10. Changes to These Terms;

Luphix Designs may update these terms from time to time. The version in effect at the time of your project agreement applies to that engagement.
